Members terms

 

These terms of use ("terms"), which may change over time, are a binding contract between you and Mystic Party Entertainment (MPE). 
 

CANCELLATIONS

Must be 48 hrs in advance or a fee applies. If you cannot make the appointment due to illness or accident we will endeavour to replace you with an equivalent member. In some instances this may not be possible and you will be expected to pay expenses.
 

PROHIBITED CONDUCT; LIQUIDATED DAMAGES

You agree NEVER to perform or try to perform any of the following, subject to applicable law. Should you breach any of these terms your membership will be disqualified immediately;

  • In any case you will not self promote your own services other than those services listed on MPE and only through MPE.

  • You will not provide verbally personal details, provide personally printed business cards or self created pamphlets or material to clients or guests.

  • You will not take bookings for private appointments, all enquiries are to be processed by MPE. You may conduct private readings/consultations outside of MPE with your own clients, solely sourced through your own publicity, that must have no links to MPE at all.

  • Ignore the code of ethics. Should we think you are no longer representing the companies ethics we reserved the right to terminate your membership with no refund.

  • You agree to not replicate or create the same or similar agency service, produce an identical party workshop or mystic dinner, which places you or your business in competition with MPE during or after your membership.

  • If your membership is terminated all materials supplied must be returned within 10 business days.

  • If you send unsolicited commercial email or advertising, bulk email, spam, or chain letters (collectively, "unsolicited email or other communication") through working for MPE, you acknowledge that you will have caused substantial harm to us. Although the amount of the harm is difficult to gauge, you will pay the licensor AUD$100 for every unsolicited email or other communication.
     

INSURANCE

MPE does not offer any insurance for members and clients. We are not liable for any accidents or injures or public liability. Members are advised to take out their own insurance. There are specialised insurance agencies that offer Entertainers insurance - speak to an insurance broker. It is the sole responsibility of the member to ensure they are covered by appropriate insurance. MPE requires its members to hold current public liability insurance and by accepting these terms and conditions, you agree that you hold current public liability insurance. The member may be requested to provide a copy of this insurance to MPE on request.
 

MINIMUM AGE REQUIREMENT

Members must be at least 21 years of age or older. Members must not knowingly provide services to under 18 years of age unless services are specifically designed for children. You have the right to deny your service to any persons unable to provide identification of their age. MPE does not knowingly book under 18 year old persons and is not responsible for any consequences.
 

PERSONAL INFORMATION

You understand that your uploaded profile image and the information you provide may be shared with clients and may be used on the website or any publication for the public to view. You also grant MPE access to qualify your said qualifications by contacting relevant parties, such as previous clients and associations.
 

CONFIDENTIALITY

MPE is committed to maintaining the privacy and confidentiality of personal information. We will adhere to the National Privacy Principles (NPPs) when collecting, using, disclosing, securing and providing access to personal information. We endeavour to take all reasonable steps to protect your personal data, but cannot guarantee the security of any data you disclose online. By supplying us with information, you accept the inherent security implications of dealing online over the internet and will agree not to hold MPE responsible for any breach of security unless we have been negligent or in willful default of our duties to you.
 

AMENDMENTS

MPE may add to, delete, or otherwise change any of the terms. MPE will notify you of any substantial changes to these terms and conditions. Your use of the MPE service after notice will constitute your deemed acceptance of such changes. It is critical that your email information and contact numbers are correct and updated regularly.
 

COPYRIGHT

Copyright in all materials and on the website is the property of MPE and must not be reproduced, in whole or in part, except as permitted under the Copyright Act 1968 or other applicable laws, or for any purpose expressly permitted by MPE.
 

LIMITATION OF LIABILITY

Nothing in this contract is to be interpreted as having the effect of excluding, restricting or modifying any condition or warranty, or right or liability implied by any applicable legislation into the arrangement between MPE and you, if such exclusion, restriction or modification would be void or prohibited by the legislation. Subject to the foregoing, MPE is not liable to you (or to any third party claiming through you) for, and you release MPE from, any loss, liability, damage, expense or cost whatsoever and includes (without limitation) indirect or consequential loss or damage, loss of profits or business opportunity, and damage to equipment or property caused by any act or omission of MPE, its employees or agent, and whether based on negligence or other tort, contract or otherwise.
 

MEDICAL & HEALTH INFORMATION

The site's content or a Mystics opinion does not constitute medical or health advice. You should not use it to diagnose, treat or cure any medical or health condition and you should not use it as the basis of a doctor-patient or health/medical advisor relationship. The information on the site or offered by Mystics offers guidance for entertainment purposes only and you should NOT rely on the medical, health, dietary, nutritional or other professional information or opinions. Always consult your personal health care provider before beginning, changing or stopping any medication or any treatment for a health problem. Users of this service accept full responsibility for any decisions, omissions or actions they take, including decisions about whether to seek professional medical care and their choice of specific treatments. Neither MPE, its parent, its affiliates, nor any of their respective members, agents, employees, information providers or content providers accept liability for your medical, health, dietary or nutritional decisions, or any results or conclusions.
 

LEGAL INFORMATION

The site's content or a Mystics opinion does not constitute legal advice and does not replace any kind of attorney-client or legal advisor relationship. Always consult your personal legal advisor before acting on any of the legal information or opinions. Neither MPE, its parent, its affiliates, nor any of their respective members, agents, employees, information providers or content providers accept liability for your legal decisions or conclusions.
 

ADDITIONAL TERMS

Agreement to transact electronically. You agree that unless otherwise stated, you will conduct all of your transactions electronically.

Legal compliance. 
You are responsible for complying with local laws, as well as being mindful that access to the site by some people (e.g. those under the age of 13) or in certain countries, may not be legal. We control this site from our Australian offices and we have designed the content for Australian audiences. If you choose to access this site from places outside the Australia, you do so at your own risk and you are responsible for compliance with applicable local laws.

Limitations on actions. 
You must act on an MPE site-related dispute within 6 months of the dispute arising or it will become void.
 

DEALINGS WITH MERCHANTS; LINKS

The site may over time contain advertisements, offers and other links to other websites and resources of third parties. The inclusion of any link on the site does not imply that we endorse the linked site.  You waive any claim against MPE and agree to indemnify MPE from any loss or damage of any kind resulting from these dealings or from the presence of these merchants or advertisers on the site.
 

MONITORING USER-GENERATED CONTENT

We reserve the right to modify or remove any content at any time. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties. We do not endorse or accept responsibility for the accuracy or reliability of any opinion, advice, information, or statement made on this site or any material.
 

TERMINATION OR CANCELLATION OF CONTRACT

MPE may terminate or suspend this contract at any time by delivering notice or by sending you a system message. Termination of this contract shall be effective the day notice is received or such later date as specified in the notice.  
 

DISCLAIMER

The content on the Mystic Party Entertainers (MPE) site and material is there for entertainment purposes only. MPE material is not professional advice and we do not accept liability if persons rely on this information. We do not accept liability for any inaccuracies or errors published or said. References to services or businesses are not an endorsement of the products or services that a person, business or organisation offers. We will try to ensure that our website is available for users as needed; however, we cannot guarantee uninterrupted site access. We are in no way responsible for the accuracy of the information or warranty in:

• A Mystics' ability to practice their service
